Terms of Use (EULA) for Zivox

These Terms and Conditions ("Terms") govern your access to and use of the Zivox mobile application (the "Application"). By downloading, accessing, or using the Application, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Application.
1. Acceptance of Terms
By using Zivox, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
2. Eligibility and Account Responsibilities
To use certain features, you may be required to create an account. You agree that:
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must provide accurate and current information when creating an account.
3. Health Data and Camera Features
Zivox may request access to health data via Android Health Connect (Android) and Apple Health (iOS). We also request camera access for calculating calories from images of food/drinks and for scanning QR codes to add friends, only with your explicit permission. Your use of these permissions is also governed by our Privacy Policy.
4. Billing and Payments
Paid features, subscriptions, billing, and refunds are processed through Google Play Billing or App Store and are subject to their respective terms in addition to these Terms.
5. Auto-Renewable Subscriptions
Zivox offers auto-renewable subscriptions to provide access to premium features. By subscribing, you agree to the following terms:
- Subscription period and price are clearly displayed in the Application's purchase screen.
- Payment will be charged to your iTunes Account at confirmation of purchase.
- Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
- Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal.
- Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
6. Acceptable Use
You agree not to:
- Use the Application for any unlawful purpose.
- Attempt to gain unauthorized access to systems or accounts.
- Interfere with the proper operation, security, or stability of the Application.
- Upload malicious code, automated abuse traffic, or harmful content.
7. Intellectual Property
All content, trademarks, logos, designs, and software in the Application are owned by or licensed to Zivox and are protected by applicable intellectual property laws.
8. Health and Medical Disclaimer
Zivox provides wellness and fitness-related information for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.
9. Limitation of Liability
To the maximum extent permitted by law, Zivox shall not be liable for:
- Loss of data, business interruption, or indirect damages.
- Inaccuracies in health metrics provided by third-party platforms or device sensors.
- Interruptions, delays, or unavailability caused by external services.
10. Termination and Account Deletion
We may suspend or terminate your access to the Application if you violate these Terms. You may also request account deletion at any time via the Application settings or by emailing zivoxapp@gmail.com. Upon request, your account will be deactivated and permanently deleted within 30 days.
11. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted in the Application with an updated "Last updated" date. Continued use of the Application after updates constitutes acceptance of the revised Terms.
